South Dakota passes Firearm Freedom Act

The rebellion grows:

Quote:

South Dakota --(AmmoLand.com)- The South Dakota Legislature has passed the South Dakota Firearms Freedom Act and that bill is enroute to the Governors desk. Governor Michael Rounds has indicated that hes comfortable with the SDFFA and will sign the bill when it reaches his office.

SD will make the fourth state that has enacted a clone of the Montana Firearms Freedom Act. Once the Wyoming and South Dakota governors sign their respective bills into law, they will join Montana, Tennessee and Utah with enacted laws.

The South Dakota bill that declares exempt from federal regulation any firearm, firearm accessory, or ammunition manufactured and retained in South Dakota was passed in the South Dakota House of Representatives today.

...
Other states are likely to finish their FFA enactments soon, including Alaska and Oklahoma.

Won't it be sweet when a majority of states pass an act like this? At what point will the feds realize that they can't stop the freight train coming right at them?

Just out of curiousity, what companies manufacture firearms in those states? Any of the big ones?

It will be interesting to see how many $$ are being recycled back into these states' local economies vs the $$ going elsewhere as a result of these legal developments... I'm sure this was an added bonus that the politicians considered...

Why do all these bills exclude automatic weapons? I want to build machine guns dammit!

Yeah, can't see that happening here in Oregon. If it weren't for Portland, Salem, and Eugene, maybe...

Have they defined what "made in state" means? Can you build a gun with parts purchased elsewhere? What about the raw materials? The way I see it raw materials don't count and by the ATF's own reasoning the receiver and no other part is the firearm but I'm sure the feds will argue all kinds of crazy stuff to try and shut this down.

Joke of the day.

These resolutions don't mean shit. The BATF thugs will continue their wickedness, and the State of South Dakota won't do a damn thing to stop them.

The way I read the law if it is significant to the operation of the firearm it HAS to be made in state. IE Ar-15 upper, even though, at this time, the ATF doesn't consider that to be a "firearm"

The law calls out that "firearm accessories" dont count, but defines that such that an upper reciever wouldn't be included

Quote:

(1) "Firearm accessory," any item that is used in conjunction with or mounted upon a firearm but is not essential to the basic function of a firearm, including any telescopic or laser sight, magazine, flash or sound suppressor, folding or aftermarket stock and grip, speed loader, ammunition carrier, or light for target illumination;
It is clear that it cannot have any significant parts from another state included, and defines insignificant parts. I would assume items NOT included on that insignificant list would be considered significant. Including barrels, BCGs, etc..

Quote:

Section 2.....This section applies to any firearm, firearm accessory, and ammunition that is manufactured in South Dakota from basic materials and that can be manufactured without the inclusion of any significant parts imported from another state. Any generic and insignificant part that has other manufacturing or consumer product application is not a firearm
and finially the definition of "insignificant"

Quote:

"Generic and insignificant part," any firearm part, including a spring, screw, nut, and pin;
You can read the entire law that they passed here:

Too bad most of the liberal gun hating population live in Eugene, Salem, Portland. I don't live in any of these cities and live mostly around gun loving, freedom loving folks. These cities control most of the Oregon politics. Of course we are just Californiaized thanks to their migration here.

-and yet, there does seem to be a lot of GiM folk that call Oregon home. There is still hope.

Damn straight! There's a lot of good folks in this state. Too bad there's so many dumbasses, too. Unfortunate, being so close to California...

Here in California we have the same contrast between the urban and rural areas, except that we don't know where all of these wacked out gun-grabbers migrated from; Venus perhaps?

I like these pro-gun laws!
